Lee’s Summit Elder Law Attorney
Guardianship, Conservatorship, & Incapacity Planning Since 2004
Elder law questions rarely arrive in isolation. A parent’s declining capacity, a sibling’s concern about a loved one’s finances, a sudden hospitalization: these moments land inside families already navigating relationships, property, and sometimes ongoing legal matters. At The Worstell Law Firm, founded by Jill Marie Worstell in 2004, we help Lee’s Summit families address guardianship, conservatorship, and incapacity planning as part of the same family law and probate practice we’ve built over two decades serving clients across Missouri and Kansas.
Our work covers civil legal matters including family law, probate, and business legal services. When elder law issues arise within those relationships, families don’t need to start over with a new firm.

Guardianship & Conservatorship Representation in Missouri & Kansas
When an adult can no longer make sound personal or financial decisions, a court can appoint someone to act on their behalf. A guardian makes personal care decisions: housing, medical care, daily safety. A conservator manages that person’s financial resources and property. One person can serve in both roles. We represent clients in contested and uncontested guardianship and conservatorship proceedings in Missouri and Kansas.
In Jackson County, these matters are heard by the Probate Division of the 16th Circuit Court. Proceedings are governed by Chapter 475 of the Revised Statutes of Missouri, which outlines how courts evaluate capacity, appoint fiduciaries, and maintain oversight of the arrangement over time.
Powers of Attorney & Healthcare Directives
A valid power of attorney can allow a family to address a loved one’s incapacity without petitioning a court at all. We draft financial durable power of attorney documents that designate who can handle financial affairs if a client becomes unable to do so. For straightforward financial durable power of attorney documents, we may offer services on a flat-fee basis.
We also draft simple and advanced healthcare directives, allowing clients to specify their medical care preferences and designate a decision-maker before incapacity occurs. Together, these documents can give families a clear path forward when it matters most.
Probate Representation for Lee’s Summit Families
Probate is the legal process of managing and distributing a person’s estate, including money, assets, property, debt, and taxes, after death. Our Lee’s Summit probate attorneys represent clients in uncontested and contested probate matters in Missouri and Kansas. We’ve provided well-informed guidance and effective legal services in probate since 2004, and we bring that same continuity to families working through elder law and estate issues together.
